General
By accessing MastahBetta.com, purchasing from MastahBetta Fish Shop, or interacting with us in-store, online, or through social media, you agree to these Terms of Service.
If you do not agree, do not use our services.
Products and livestock
All live fish are sold as living animals and may vary in size, color, pattern, and behavior.
Photos and videos are for reference only unless explicitly stated as WYSIWYG (what you see is what you get).
Fish size listed is an estimate and may vary.
Live fish policy
All live fish purchases are subject to our Live Fish Guarantee & Shipping Policy.
By purchasing, you acknowledge that:
- fish health after purchase depends on your care and environment
- improper acclimation can result in death
- responsibility transfers to you after pickup or delivery
Acclimation responsibility
You agree that proper acclimation is required for all fish.
Failure to properly acclimate fish, including not adjusting water parameters, may result in loss and void any guarantee.
Orders and payments
- All sales are final unless covered under our Live Fish Guarantee
- Payment must be completed before fish are released or shipped
- We reserve the right to cancel or refuse any order
Shipping and risk transfer
- Fish are packed using professional methods
- Once fish are received alive, all responsibility transfers to the customer
- We are not responsible for carrier delays, mishandling, or transit issues
Inventory accuracy
Inventory counts may not always be exact.
If an item is out of stock after purchase:
- we will contact you
- you may choose replacement, credit, or adjustment
Pre-orders
- All pre-order fish are non-refundable
- Pre-order timelines are estimates and may change
- Delays outside of our control may occur
- Anything Pre-Ordered must be picked up within 7 days of arrival (to the shop).
- MastahBetta Fish Shop is not responsible for any pre-order that dies or is damaged AFTER the 7 days pickup window.
- Customer will be void of all coverage/refunds if pre-order is NOT picked up within 7 days of arrival (to the shop).
User accounts
If you create an account:
- you are responsible for maintaining login security
- you are responsible for all activity under your account
Prohibited conduct
You agree not to:
- violate laws
- commit fraud
- disrupt the website
- upload harmful code
- impersonate others
Intellectual property
All content on MastahBetta.com belongs to MastahBetta LLC and may not be used without permission.
Third-party services
We are not responsible for third-party websites, services, or platforms linked to or used in connection with our business.
Limitation of liability
To the maximum extent permitted by law, MastahBetta Fish Shop is not liable for:
- losses due to improper care, acclimation, or tank conditions
- fish loss after introduction into your system
- damage caused by fish to other livestock or equipment
- indirect or consequential damages
Maximum liability is limited to the purchase price of the item.
Indemnification
You agree to indemnify and hold MastahBetta LLC harmless from any claims, damages, or expenses resulting from your use of our services or violation of these terms.
Dispute resolution
Any disputes shall be resolved through binding arbitration in the State of Hawaii.
Right to refuse service
We reserve the right to refuse service to anyone for any reason, including abusive behavior or violation of our policies.
Policy enforcement
We reserve the right to:
- approve or deny claims
- interpret all policies
- make final decisions on disputes
Modifications
These Terms may be updated at any time without prior notice.
